1) Introduction data protection

Our teams make every effort to offer you the highest standards of service. To this end, we need to process certain information about you in order, in particular, to create and manage your «Candidate» account, or «Recruiter account», as well as all the services necessary for 321jobs in the context of its activities and the performance of its contractual obligations. As part of this processing, 321jobs undertakes to treat your data confidentially in accordance with the legal provisions in force

321jobs attaches great importance to transparency and the protection of personal data. In order to inform you in a clear and complete manner about how we process your data, we have described in this document the details of the processing carried out by 321jobs tools (hereinafter «321jobs», or «,we»,) both in the context of the execution of a contract concluded with a Client (hereinafter the «,Client») and when accessing and/or registering any person who has not yet concluded a contract with 321jobs (hereinafter the «,User», or «,Candidate») (hereinafter jointly referred to as «,you»,). The purpose of this document is therefore to inform you more about how your personal data is collected and processed by 321jobs, and how it may, where appropriate, be passed on to third parties

Here are some definitions that will help you better understand this document.

- «personal data or data»,: any information concerning an identified or identifiable natural person (for example: a Client or a recruiter or a Candidate, each being a User);

- «identifiable natural person»: a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, Customer or User reference, location data, an online identifier, or to one or more specific elements specific to his or her professional career;

- «data subject», shall mean any identified or identifiable natural person;

-«Processing or treatment» means any operation or set of operations which is applied to personal data. For example: collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, limiting, erasure or destruction;

- «profiling» means any form of automatic processing of personal data consisting in the use of personal or career data to evaluate certain aspects relating to a natural person

- «controller» shall mean the natural or legal person who alone or jointly with others determines the purposes and means of the processing operation. For the purposes of this Privacy Policy, 321jobs is considered as a joint controller (see Article 10.1);

«Web Services» include the provision by 321jobs:

a) several public websites, applications, either in their own name or integrated with Customers via career pages;

b) a personalised «User account», accessible via the «,My User Space» interface (https://my.321jobs.eu/) of the website www.321jobs.eu or its integration with our Clients allowing you, if you are already a Client / User, to permanently access and/or modify your personal data

(c) electronic means of communication: chat, e-mail, etc.

2)What data do we process?

2.1 As part of the provision of products and services offered by 321jobs

To benefit from the products or services offered by 321jobs, you must first provide 321jobs with personal data about yourself, except for the simple consultation of job offers. The categories of data likely to be processed in this context are, in particular:

- Identifying data such as e.g. surname, first name, date of birth, language, postal address, e-mail address, mobile and/or landline telephone number, company identification data for recruiters...

- For Clients/Recruiters only: billing data such as billing address, bank account number, direct debit mandate (if applicable)

- If you are already a Client / User 321jobs, the contractual data such as for example: Client reference, price list, product, contract

- Communications between you and 321jobs using available communication channels such as postal mail, e-mail, SMS and web chat.

2.2 In the use of the websites, applications and career pages 321jobs

When you access and/or register and/or use the web services offered by 321jobs, we collect and process personal data about you. This data is collected when you access and/or register for web services via the website www.321jobs.eu, including in its variations on the sites of its Clients, as well as during any subsequent use

The information likely to be collected automatically each time a User accesses the site is for example: the IP address assigned to you when you connect, the date and time of access to the website or application, the pages consulted, the type of browser used; the platform and/or the operating system installed on the device (computer, tablet, smartphone, etc.); the search engine and the keywords used to find the site.

2.3.Data from third party partners

We may receive data about you from our third party partners, such as subcontractors with whom we collaborate to provide a service, advertisers or other partners that have collected your data

Such data transfers shall always be carried out in compliance with the applicable legislation

It is also conceivable that we may process public data about you.

2.4. Sensitive data

As a general rule, 321jobs does not use your sensitive personal data such as data relating to your sexual orientation, religious or political beliefs, health or ethnicity

However, if sensitive data is present on your resume, and you attach it to an Application to a recruiter or give this kind of information in electronic exchanges, the recruiter will have access to this data

3) How and for what purposes do we use your data?

Your data may be collected and processed by 321jobs:

3.1 As part of the execution of your contract

Your data is processed by 321jobs when concluding a contract relating to the supply of products and services offered by 321jobs. 321jobs uses your data in particular as follows:

- to allow you to apply for a job, to subscribe to job alerts, and to communicate between candidates and recruiters;

- for the supply/use of the products and services ordered;

- for the preparation, issue and possible collection of invoices and credit notes;

- as part of the general management of the Customer relationship, in particular: accounting, after-sales service, sending notifications, handling your questions, complaints and communications

3.2 Where we have a legitimate interest in using your data

In addition to the processing related to the execution of your contract, 321jobs has a legitimate interest in carrying out processing operations that are not directly necessary for the execution of your contract. An analysis of each of these processing operations will be carried out beforehand in order to guarantee the respect of your private life. We can send you the results of these analyses on simple request to admin@321jobs.eu.

Below you will find an overview of the processing operations that are based on our legitimate interest:

- 321jobs may process your data in order to defend its interests in the management of litigation, disputes and/or legal proceedings;

- Your data may be processed as part of an audit of 321jobs by third party companies;

- 321jobs processes your data for analysis purposes and, in particular: analysis of the behaviour of our Clients/Users, statistical analysis. The results of these analyses allow us to improve our services and to draw up reports;

- 321jobs uses your data in order to simplify your Client/User journey and, for example, to prevent you from having to provide information that you have previously provided several times;

- Your data is used in the context of the continuous updating of our computer systems: thus, your data is used in the context of tests necessary for the computer developments that we put in place;

- Your data may be used for the continuous evaluation, improvement and development of our systems, processes, advertising campaigns, for example through simulations, satisfaction surveys or the analysis of your navigation data on our website ;

- If necessary, your data may be processed and transferred in the context of an assignment of claims against you to a debt collection agency;

- Your data may also be used to determine which products and services might be of interest to you and to offer you products similar to those you already benefit from

3.3.In order to comply with a legal obligation

321jobs may process your data in order to comply with a legal obligation.

3.4. With your consent

In accordance with current regulations and only with your consent, 321jobs may use your data in order to:

- To provide you with personalized offers and commercial communications relating to the products and services offered by 321jobs;

- Send you his newsletter.

4) Is your data shared ?

4.1 Selling your data

We guarantee that your data will not be sold to third party companies.

- Our operational partners: these companies assist 321jobs in the fulfilment of its contractual obligations. For example, they take care of printing your invoices;

- Our partners in the provision of products and services: these companies act on behalf of 321jobs in the provision of the services offered by 321jobs

- Our marketing partners: these companies help us, for example, to carry out analyses on your data in order to help us serve you better

Our IT partners: we may use external companies to develop, improve, modify or secure our IT systems or to make available applications, tools, services, etc. used within the framework of 321jobs' activities;

- Your data may be communicated to companies specialising in solvency investigations;

- 321jobs may disclose your data to bailiffs, lawyers, banks and debt collection agencies if necessary,

- Your data may be communicated to our partners so that they can offer you our commercial offers via their communication channels (e.g. Facebook, Twitter, Linkedin, etc.);

- Your data may be communicated to our partners in order to exclude you from a communication from them (data matching) ;

4.4. Other transfers

- In the event of an assignment of a claim, some of your data is also assigned to the assignee. The assignee is then entitled to recover the claim on his own behalf;

- 321jobs may communicate your data to the public authorities referred to in Article 3.3.;

4.5. Transfer of data to a country that is not a member of the European Economic Area

321jobs only transmits your data to a country that is not a member of the European Economic Area (the European Economic Area is made up of the members of the European Union as well as Iceland, Norway and Liechtenstein) where that country ensures an adequate level of protection within the meaning of the legislation in force or to the extent permitted by the legislation in force, for example by ensuring data protection through appropriate contractual provisions

5) What are your rights?

You have several rights regarding the processing of your data. 321jobs will do what is necessary to satisfy your requests as soon as possible and in any case within one month of receipt of the request. If necessary, this period may be extended by two months, taking into account the complexity and number of requests

5.1 You have the right to access your data.

- If you are a Client/User or a former Client/User of 321jobs, you have the right to consult your personal data at any time by logging on to your User space https://my.321jobs.eu/. However, some data is not directly visible from your User space and can only be consulted on express request. Furthermore, if you have requested to delete your account, no data is kept

- If you are not a Client/User or a former Client/User of 321jobs, as well as for all the data that is not directly available from your Client space, you can exercise your right by sending a request to the email address admin@321jobs.eu or by post to the address in point 10.1.

5.2.You have the right to rectify your data

If you are a Client/User or a former Client/User of 321jobs and you notice that one or more of your data is incorrect, you have the possibility of modifying them directly in your Client space (https://my.321jobs.eu/)

If you are not a Client/User or a former Client/User of 321jobs, you can exercise your right by sending a request to the email address admin@321jobs.eu or by post to the address given in point 10.1

5.3.You have the right to request the deletion of your data.

If you wish to request the deletion of your data held by 321jobs, you can exercise your right by sending a request to the email address admin@321jobs.eu or by post to the address in point 10.1. If you are a Candidate, you can also make this request via your User space https://my.321jobs.eu/.

Attention, if you are a client/recruiter or a former client/recruiter of 321jobs, some of your data must be kept for the following reasons:

Existing clients / recruiters: we need to keep your data: (i) for the proper execution of your contract, i.e. to continue to supply our goods and services, to send invoices, etc.; (ii) to enable us to comply with our legal retention obligations (mainly accounting and tax obligations)

Former clients / recruiters: we also keep your data: (i) if there is any amount outstanding, i.e. if you have not yet paid all your 321jobs invoices or if we still have to make a payment to you; (ii) in order to be able to answer any questions or complaints after the end of the contract; or (iii) to enable us to comply with our legal retention obligations (mainly accounting and tax obligations)

Your removal request may therefore be refused if you are currently a 321jobs client/recruiter or have been within the last two years.

5.4 You have the right to request a copy of your personal data and to request its transfer to a third party (right of portability).

If you are a Client/User or a former Client/User of 321jobs, you have the possibility of downloading a copy of the data that you have transmitted to us directly from your Client space (https://my.321jobs.eu/).

If you are not a Client/User or a former Client/User of 321jobs, you can exercise your right by sending a request to the email address admin@321jobs.eu or by post to the address in point 10.1

5.5.You have the right to change your consents at any time.

If you are a Client/User or a former Client/User of 321jobs, you can easily manage your preferences relating to certain processing of your data by 321jobs directly from your Client space (https://my.321jobs.eu/)

These modification requests will be processed immediately but their implementation will not necessarily be immediate given the computer and technical constraints of 321jobs

If you are not a Customer or a former Customer of 321jobs, you can exercise your right by sending a request to the email address admin@321jobs.eu or by post to the address given in point 10.1

For certain communication channels operated by subcontractors or third parties (notably Facebook, Twitter and Linkedin), you can manage your consents directly on the website concerned (for example by modifying your preferences on these platforms)

5.6.You have the right to request the limitation of the processing of your data.

You may obtain the restriction of a processing operation where you have objected to the processing, where you contest the accuracy of the data or where you consider that the processing is unlawful

5.7.You have the right to object to the automatic processing of your data.

Certain data processing is carried out without human intervention, in an automated manner. You have the right to object to such processing by justifying your request

6) What security measures do we apply ?

6.1 Technical and organizational measures

321jobs takes the appropriate technical and organisational measures to guarantee the security of your personal data

Thus 321jobs makes every effort to provide for measures that prevent, as far as possible:

- unauthorized access or modification of data. Only those persons who are supposed to have access to your data in the context of their function have access to it;

- the improper use or disclosure of such data;

- the unlawful destruction or accidental loss of such data

A continuous monitoring of our systems is also in place in order to prevent and deal with any external attack (hacking)

Finally, all 321jobs employees with access to this data are subject to a strict obligation of confidentiality.

321jobs cannot however be held responsible in the event of misappropriation of all or part of this data by a third party, despite the security measures adopted

6.2 Your role

As a User, or former User, you also have a role to play in the protection of your personal data. For example, never give your Customer area login and password to a third party. Your personal data is accessible there and could then be stolen.

7) How long do we keep your data ?

321jobs retains the personal data of its Clients and Users for as long as is necessary to achieve the purposes for which it was collected (see point 3)

321jobs may also continue to hold personal data about a former Client (inactive Client):

- (i) if there is any amount outstanding, i.e. if you have not yet paid all your 321jobs bills or if we still have to make a payment to you;

- (ii) in order to be able to respond to any questions or complaints after the end of the contract; or

- (iii) to enable us to meet our legal retention obligations (mainly accounting and tax obligations).
